General conditions of sale/reservation
Article 1: This seasonal rental contract is reserved for the exclusive use for the rental of the accommodation Gîte Jules Romains, Saint Julien Chapteuil, France.
Article 2 - Duration of the stay: The tenant who is a signatory to this contract concluded for a fixed period may under no circumstances avail himself of any right to remain in the premises at the end of the stay.
Article 3 - Conclusion of the contract: The reservation becomes effective as soon as the tenant has sent the owner a deposit of 25% of the total amount of the rental. This deposit payment constitutes acceptance of the GCS (General Conditions of Sale). The entire amount of the rental is due no later than 30 days before the start of the rental.
The rental concluded between the parties to this act may under no circumstances benefit even partially to third parties, natural or legal persons, unless the owner agrees in writing.
Any infringement of this last paragraph would be likely to result in the immediate termination of the lease to the detriment of the tenant, the proceeds of the rental remaining definitively acquired by the owner.
Article 4 - Absence of withdrawal: For reservations made by mail, telephone or the internet, the tenant does not benefit from the withdrawal period, in accordance with Article L121-21-8 of the Consumer Code relating in particular to the services of accommodation services provided on a specific date or periodicity.
Article 5 - Cancellation by the tenant : Any cancellation must be notified in writing to the owner.
A) cancellation before arrival at the premises:
If the cancellation occurs more than 2 months before the expected rental date, the entire deposit will be refunded within one week of the cancellation.
The deposit of 25% remains with the owner if the cancellation occurs between 2 months (60 days) and 30 days before the scheduled date of entry into the premises.
The total amount of the rental remains with the owner if the cancellation occurs less than 30 days before the expected date of entry into the premises.
If the tenant does not show up within 24 hours of the date of arrival indicated on the contract, this contract becomes void and the owner can dispose of his lodging. The entire amount of the rental also remains with the owner.
B) if the stay is shortened, the price of the rental remains with the owner. No refund will be made.
Article 6 - Cancellation by the owner: The owner pays the tenant all the sums paid within a period not exceeding one week.
Article 7 - Arrival: The tenant must show up on the specified day and time mentioned in the booking confirmation message. In case of late or delayed arrival, the tenant must notify the owner.
Article 8 - inventory: An inventory is drawn up jointly and signed by the tenant and the owner or his representative on arrival and departure from the cottage. This inventory is the only reference in the event of a dispute concerning the inventory. The B&B formula does not require the establishment of an inventory.
The tidiness of the cottage upon the arrival of the tenant must be noted in the inventory. The daily cleaning of the premises is the responsibility of the tenant during the rental period. The final cleaning is the responsibility of the owner. In the event of an unsanitary condition of the rented property, the additional cleaning amount is €250.
Article 9 - Security deposit: Before the tenant's arrival, a security deposit of €250 is requested by the owner. After the contradictory establishment of the exit inventory, this deposit is returned, less the cost of restoring the premises if damage occurred. Otherwise, the entire security deposit is returned by the owner (or returned personally if applicable) within a period not exceeding one week.
Article 10 - Use of the premises: The tenant must ensure the peaceful nature of the rental and make use of it in accordance with the destination of the premises.
Article 11 - Capacity: This contract is established for a maximum capacity of 4 or 6 people (as agreed during the reservation of the cottage). If the number of tenants exceeds this capacity, the owner may refuse additional people. Any modification or breach of the contract will be considered at the customer's initiative.
Article 12 - Acceptance of animals: When booking, the customer is required to indicate the pet that will accompany him (1 animal maximum). If necessary, the description sheet specifies the possible tariff supplements to be expected (animal rate, security deposit supplement, cleaning package supplement...). Specific conditions of stay for pets may be specified by the owner in an internal regulation displayed in the accommodation.
Article 13 - Insurance: The tenant is responsible for all damage caused by him. He is required to be insured by a resort type insurance contract for these different risks.
Article 14 - Payment of charges: At the end of the stay, the tenant must pay to the owner, the charges not included in the price. Proof is provided by the owner.
Article 15- Disputes: Any claim relating to the inventory and the state of the interior at the time of rental must be made at the time of drawing up the inventory.
